Liability Waiver

This waiver is part of the Terms of Service. The person who creates the account agrees to it for the camp, and confirms they are allowed to.
CampOffice is office software
CampOffice helps a camp office keep records and send messages. It is not a safety, medical, transportation or emergency system, and it does not replace the people who look after campers. Your camp alone is responsible for running camp, including:
- Supervision and safety. Headcounts, rosters and bunk lists help, but the camp's staff are responsible for knowing where every camper is.
- Health and medical care. The infirmary log, medical forms and allergy notes are records only. They are not medical advice, and decisions about care are made by the camp's medical staff and parents.
- Buses and transportation. Routes, stops and times come from the camp and its bus company. The camp and the bus company are responsible for getting campers there and home safely.
- Emergencies. Texts, emails, calls and the camp phone line can be late or not arrive. In an emergency, call 911 and reach families directly. Don't rely on CampOffice alone to reach anyone in time.
- Hiring staff. Staff applications and references help you decide, but the camp is responsible for its own interviews, background checks, and any checks the law requires.
- Payments and money. The camp is responsible for checking payments, balances and what goes to its books.
- The AI helper and suggestions. Suggested bunks, matches, drafts and answers can be wrong. A person at the camp decides.
Release
To the fullest extent the law allows, your camp releases FlexVivid, and its owners, staff and contractors, from claims for injury, illness, death, property damage or loss that come from the camp's activities, programs, staff, transportation, medical care or emergency response, including where CampOffice was used to keep records or send messages about them.
Covering us
Your camp will cover FlexVivid against claims by campers, parents, staff or others that come from the camp's activities or from how the camp used CampOffice, including reasonable lawyers' fees.
What this doesn't cover
This waiver does not limit anything the law doesn't allow to be limited, such as responsibility for our own fraud or deliberate wrongdoing.
